&lt;p&gt;Soloway was charged under the CAN-SPAM Act, which allows judges to impose a maximum sentence of five years. Soloway was alleged to have continued sending emails even after Microsoft and an Oklahoma ISP won judgments against him todally $17 million for sending millions of spam emails by using malware to send the emails from compromised home PCs.&lt;/p&gt;
